Collective Sale of Harbour View Gardens Not Approved by High Court

The High Court of Singapore refused to approve the collective sale of Harbour View Gardens because of incentive payments made by certain owners to a non-consenting owner who is also a member of the collective sale committee.

The High Court also held that it was improper for professional advisers in a collective sale to place themselves in a position where their interests conflict with their duty to all owners.

The decision N K Rajarh v Tan Eng Chuan is reported in [2013] 3 SLR 103. Our Mr Lim Seng Siew appeared for the successful objectors to the collective sale.
