OTP Law Corporation acted for a successful owner in her claim against her upper floor neighbour for water leakages.
The Strata Title Board agreed with our submissions and applied the presumption under s.101(8) of the Building Maintenance And Strata Management Act. The Board also agreed with our client and her building surveyor expert that the leakages were from her upper floor neighbour.
The Board ordered the upper floor neighbour to repair the leaks to the satisfaction of the expert and to pay costs.
The successful owner was represented by Mr Ong Ying Ping. The case is STB No.100 of 2012.
